Memorandum

The laws of the state of Colorado, in regards to regulations of paralegals and applications of the unauthorized practice of law, are as follows. Paralegals and legal assistants cannot practice law in Colorado (Colorado Supreme Court). No direct legal advice may be given by a paralegal, as the potential lack of knowledge may dissrupt a client’s well-being. Only under the supervision of an authorized attorney may a paralegal work, and the attorney is responsible for the client’s well-being of a legal issue.
As the Colorado Supreme Court has declared as any practice of law as an action in representation of the law and in defense of legal rights of others and as an advisor in connecting the rights and duties. Generally, one who is not an attorney, suspended, disbarred, or otherwise unauthorized to practice law, cannot give any sort of legal advice, draft legal documents on account for other person’s, and so on. As the Colorado State Constitution is the ultimate source for the knowledge of the unauthorized practice of law.
Some consequences for an unauthorized practice of law, in the state of Colorado, can range from a relatively minor consequence compared to a more serious punishment. Written agreements may be one way to deter one from an unauthorized practice of law, declaring that the accused will no longer committ unauthorized practices of law. If an individual refuses, or if the offense is quite serious, it will move into an injunctive proceeding, contempt proceedings, and otherwise sanctions against the accused.
